2:00 PM | General Session | Implementing and Managing a LKE Program for Your Lease Portfolio
Speaker - Rick Reekie | Partner | PricewaterhouseCoopers LLP

PricewaterhouseCoopers LLP The IRS recently clarified like kind exchange ("LKE") guidelines on long standing rules that allow you to indefinitely defer federal and state income tax due on the sale of off lease assets. Here is how it works. For every leased asset that is sold and replaced, you treat the sold asset as if it had never been disposed and continue to depreciate it for its remaining life. Any additional funds (over the sales proceeds) needed to acquire the new asset are then depreciated under a separate schedule. To determine depreciation for the exchange, the two layers are combined. The deferral of the gain on the sale of the old asset reduces the basis in the acquired property.

PricewaterhouseCoopers Like-Kind Exchange Services group offers a full-service like-kind solution for the leasing industry. Most lessors pay 40% of the sales proceeds in federal and state tax because they are unaware of these rules and fail to properly structure the sale and replacement of their off lease assets to qualify as a like-kind exchange.

In effect, LKE turns the temporary timing difference afforded by accelerated tax depreciation into a permanent interest free loan on your portfolio costs. With the successful implementation of an LKE program, our clients indefinitely defer recognizing the tax gain on disposition of their leased property for as long as they continue to replace leases.

PwC's LKE solution is a comprehensive approach that addresses both the operational procedures and systems issues inherent in establishing and maintaining an LKE program in a cost efficient manner.

LKE Advantages:
  • Increased cash flow
  • Debt reduction
  • Business expansion
  • Stakeholder distributions
  • Pricing/competitive advantages
  • Outsourced tax compliance for all leased assets

10:15 AM | General Session Public Relations - Maximizing Industry Exposure, Managing Reputation
Speaker - Susan Carol | CEO | Susan Carol Associates

Susan Carol Associates Your company brand and your reputation are mission-critical assets. Do they get the attention they deserve? Public relations (PR) is about protecting and illuminating the brand, and protecting reputation. It communicates--through stories--your value proposition, and it facilitates internal and external two-way communications. If integrated at top management levels, it will help prevent crisis communications and support business development.

New Internet communication tools (Podcasting, RSS Feeds, Video Streaming, as examples) enable innovative ways to reach micro- targeted audiences quickly and in multiple ways. They often enable dynamic interaction and participation. But they also increase reputation risk. Today there are citizen journalists capturing and disseminating stories, while hungry 24-hour media channels seek to engage us in ever more sensational features. Advertising revenue is a problem within traditional media outlets; they are changing their own formats and services. This eliminates some PR opportunities, but creates new ones your professional agent should explore.

This presentation will discuss how to integrate online and off-line communications, take advantage of PR opportunities specific to the equipment finance industry, and avoid damage to your brand or reputation. Susan Carol, a professionally accredited public relations counselor with more than 2 decades of experience, will specifically address how equipment leasing and finance organizations can maximize their Web presence, take full advantage of special events, and use measurable communications strategy. She founded Susan Carol Associates Public Relations in 1989, following employment at MCI and before that the Equipment Leasing and Finance Association.
